TERMS AND CONDITIONS & WAIVER OF LIABILITY FOR GYM USE
Accident/Incident/Death Cover
I/We hereby understand and acknowledge that the training at Peak Fitness Gym may expose me to many inherent risks, including accidents, injury, illness, or even death.
I/We assume all risk of injuries associated with participation including, but not limited to, falls, contact with other participants and/or Gym equipment, the effects of the weather, including high heat and/or humidity, and all other such risks being known and appreciated by me.
I/We hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activities held within the Peak Fitness Gym facility.
I/We acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in.
Loss or damage to property cover
I/We hereby acknowledge the risk of damage or loss to my property whether by negligence or the wilful damage by others.
No Supervision Cover
I/We understand that I am purchasing a membership at a unsupervised facility that allows access at any time within the operational hours given.
I/We are aware that there will be no supervision or assistance except during staffed hours. Staffed hours may change at the sole discretion of Peak Fitness Gym.
I/We are aware that if I get injured, become unconscious, suffer a stroke or heart attack or any other medical emergency or event that there will likely be no one to respond to my emergency and that the Peak Fitness Gym has no duty to provide assistance to me while I am at the gym.
I understand that even though the gym is equipped with surveillance cameras, these record but are not monitored continuously, help will not be available during non-staffed hours.
I should carry my own communication device to alert 111 that an emergency is occurring.
By my signing name I/We indicate that I/We have read and understand this Waiver of Liability. I am aware that this is a waiver and a release of liability and I voluntarily agree to its terms.
Authorised Access for Member Only
I/We agree that improper unauthorised use of the facility may result in member suspension or cancellation. I agree not to let anyone use my card for any reason, and I agree to report any situation that appears to be card-sharing to the owners. A security “tailgate” system has been installed to monitor and record instances of “tailgating”.
I understand that one act of card sharing will result in immediate membership suspension or termination. The gym reserves the right to suspend or cancel the rights,
privileges and membership of any member whose actions are detrimental to the use, safety, and enjoyment of the facilities.

Payments
A Minimum 3 month Membership is required.
All prices include GST.
Pricing structure is subject to change on an annual basis.
Applicable for 12month Memberships only that have been paid by cash.
Transferring or suspending your membership
You can transfer your membership or freeze/suspend your membership for the following reasons only.
-You fall Pregnant.
-You fall Seriously ill.
-And/Or You have a serious injury.
After having read this waiver and knowing these facts, and in consideration of acceptance of my participation, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVE AND RELEASE – Peak Fitness Gym, its directors, contractors, employees, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in activities held at Peak Fitness Gym.
